Gunsmithing Service Agreement, Liability Waiver, and Storage Policy

By signing this agreement, I ("Customer") authorize Modern Manufacturing LLC dba Modern Gun ("Modern Gun") to inspect, service, repair, modify, clean, customize, or otherwise perform work on the firearm(s) identified in this transaction.

1. Ownership and Legal Eligibility

I certify that:

  • I am the lawful owner of the firearm(s) or have legal authority to authorize work.

  • I am legally permitted under federal, state, and local law to possess the firearm(s).

  • The firearm(s) have not been reported stolen.

  • All information I provide is true and accurate.

2. Authorization for Work

I authorize Modern Gun to perform the requested services and any additional work approved by me during the course of the repair.

I understand that estimates are provided in good faith and that unforeseen issues may require additional labor or parts. No additional charges beyond the estimate will be incurred without my approval unless necessary to make the firearm safe.

3. Firearm Condition

I acknowledge that Modern Gun is accepting my firearm in its current condition. Modern Gun is not responsible for pre-existing defects, excessive wear, prior modifications, hidden damage, rust, corrosion, broken components, or unsafe conditions that existed before service.

If my firearm is determined to be unsafe or beyond economical repair, Modern Gun may recommend against firing or further use.

4. Test Firing

I authorize Modern Gun to test fire my firearm when necessary to verify proper function, reliability, accuracy, or safety after repairs or modifications.

5. Assumption of Risk

I understand that firearms are inherently dangerous and that improper handling, maintenance, modifications, defective ammunition, misuse, or mechanical failure may result in serious bodily injury, death, or property damage.

I accept full responsibility for the safe handling, storage, transportation, and use of my firearm after it leaves the possession of Modern Gun.

6. Release of Liability

To the fullest extent permitted by law, I release and hold harmless Modern Manufacturing LLC dba Modern Gun, its owners, employees, contractors, agents, and representatives from any claims, demands, liabilities, damages, injuries, losses, attorney's fees, or expenses arising out of or relating to:

  • Gunsmithing services performed;

  • Cleaning or maintenance;

  • Installation of parts or accessories;

  • Firearm modifications requested by me;

  • Normal wear or mechanical failure;

  • Use or misuse of the firearm after it is returned to me;

  • Ammunition selection or ammunition-related malfunctions.

This release does not apply to liability that cannot legally be waived.

7. Warranty

Unless otherwise provided in writing, Modern Gun warrants its workmanship for thirty (30) days from the date the firearm is returned to the customer.

Manufacturer warranties remain the responsibility of the manufacturer.

No other express or implied warranties, including warranties of merchantability or fitness for a particular purpose, are made.

8. Storage Policy

Modern Gun will notify the Customer when the firearm is ready for pickup using the contact information provided.

The Customer agrees to retrieve the firearm promptly after notification.

A seven (7) calendar day grace period will be provided after notification that work is complete.

Beginning on the eighth (8th) calendar day after notification, a storage fee of Five Dollars ($5.00) per firearm, per calendar day will accrue until the firearm is picked up.

Storage fees must be paid in full before the firearm will be released.

9. Unclaimed Firearms

If a firearm remains unclaimed for 45 days, Modern Gun will make reasonable efforts to contact the Customer using the contact information provided.

The Customer understands that firearms cannot simply be abandoned and that Modern Gun will exercise all rights and remedies available under applicable federal, state, and North Carolina law regarding unclaimed firearms, including the recovery of unpaid storage fees, costs, and other lawful remedies.

The Customer remains responsible for all accrued storage charges, collection costs, and reasonable attorney's fees where permitted by law.

10. Identification Requirements

Modern Gun reserves the right to require valid government-issued photo identification before releasing any firearm.

Firearms will only be released to the lawful owner or another person legally authorized to receive them and only in compliance with applicable federal and state law.

11. Compliance with Law

Customer agrees to comply with all applicable federal, state, and local firearm laws.

Modern Gun reserves the right to refuse service or refuse to release any firearm if doing so would violate any law or regulation.

12. Limitation of Liability

To the maximum extent permitted by law, Modern Gun's total liability arising from any claim relating to services performed shall not exceed the amount paid by the Customer for those services.

Modern Gun shall not be liable for incidental, consequential, indirect, or special damages.

13. Entire Agreement

This Agreement constitutes the entire understanding between the Customer and Modern Gun regarding the services provided and supersedes any prior oral or written agreements.

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
